Regulation under the Environmental Planning and Assessment Act 1979.

Explanatory note
The object of this Regulation is to amend the Environmental Planning and Assessment Regulation 2000 to require development applications for consent to carry out development on land within the South East Wilton Precinct (as specified by State Environmental Planning Policy (Sydney Region Growth Centres) 2006) to be accompanied by an assessment of the consistency of the proposed development with the South East Wilton structure plans. The assessment will be taken into account by the consent authority when determining whether to grant development consent under that Policy.
This Regulation is made under the Environmental Planning and Assessment Act 1979, including sections 4.12 and 10.13 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Environmental Planning and Assessment Amendment (South
East Wilton Precinct) Regulation 2018.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.
3 Amendment of Environmental Planning and Assessment Regulation 2000
Clause 275A
Insert after clause 275:
275A Development assessment in South East Wilton Precinct
(1) This clause applies to land within the South East Wilton Precinct under State Environmental Planning Policy (Sydney Region Growth Centres)
2006.
(2)
Pursuant to section 4.12 of the Act, a person cannot apply to a consent authority for consent to carry out development on land to which this clause applies unless the application is accompanied by an assessment of the consistency of the proposed development with the South East Wilton structure plans.
(3) In this clause: South East Wilton structure plans means the following:
(a) the Wilton Interim Land Use and Infrastructure Implementation Plan dated August 2017 and published on the Department’s
website,
(b) the South East Wilton Precinct Structure Plan dated
