Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Environmental Planning and Assessment Act 1979.

Explanatory note
The object of this Regulation is to prescribe a new set of bush fire protection guidelines (known as Planning for Bush Fire Protection) that must be conformed with in relation to development of bush fire prone land under the Environmental Planning and Assessment Act 1979.

This Regulation is made under the Environmental Planning and Assessment Act 1979, including sections 79BA and 157 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Environmental Planning and Assessment
Amendment (Planning for Bush Fire Protection) Regulation 2007.

2 Amendment of Environmental Planning and Assessment Regulation 2000

The Environmental Planning and Assessment Regulation 2000 is amended by inserting after clause 271 the following clause:

272 Planning for Bush Fire Protection

For the purposes of section 79BA (1) (a) of the Act, the document entitled Planning for Bush Fire Protection, ISBN 0 9751033 2 6, prepared by the NSW Rural Fire Service in co-operation with the Department of Planning, dated December 2006, is prescribed.
