Explanatory note

The object of this Regulation is to prescribe the Development Assessment Guideline: An Adaptive Response

to Flood Risk Management for Residential Development in the Penrith City Centre as a matter the consent
authority must consider in determining a development application for new residential development in
Penrith City Centre.

This Regulation is made under the Environmental Planning and Assessment Act 1979, including sections 4.15 and 10.13 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Environmental Planning and Assessment Amendment (Penrith

City Centre) Regulation 2019.

2      Commencement

This Regulation commences on 28 June 2019 and is required to be published on the
NSW legislation website.

3 Amendment of Environmental Planning and Assessment Regulation 2000

(1) Clause 92 Additional matters that consent authority must consider

Insert after the note to clause 92 (1) (e):

(f) in the case of a development application for development for the erection of a building for residential purposes on land in Penrith City Centre, the Development Assessment Guideline: An

Adaptive Response to Flood Risk Management for Residential Development in the Penrith City Centre published by the

Department of Planning and Environment on 28 June 2019.

Note. A copy of the Guideline is available on the website of the

Department.

Insert in alphabetical order:

Penrith City Centre means the City Centre as defined in Penrith Local
Environmental Plan 2010.
