Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Environmental Planning and Assessment Act 1979.

Explanatory note
The object of this Regulation is to amend the Environmental Planning and Assessment Regulation 2000 to clarify the requirements for inclusion of information relating to flood related development controls applicable to certain development on land in planning certificates.

This Regulation is made under the Environmental Planning and Assessment Act 1979, including sections 149 and 157 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Environmental Planning and Assessment Amendment (Flood Related Development Controls Information) Regulation 2007.

2      Commencement

This Regulation commences on 16 February 2007.

3 Amendment of Environmental Planning and Assessment Regulation 2000

The Environmental Planning and Assessment Regulation 2000 is amended as set out in Schedule 1.

(Clause 3)

[1]      Schedule 4 Planning certificates

Omit “flooding, tidal inundation, subsidence, acid sulphate soils or any other risk” from clause 7.

Insert instead “tidal inundation, subsidence, acid sulphate soils or any other risk (other than flooding)”.

[2]      Schedule 4, clause 7A

Insert after clause 7:

7A Flood related development controls information

(1)

Whether or not development on that land or part of the land for the purposes of dwelling houses, dual occupancies, multi dwelling housing or residential flat buildings (not including development for the purposes of group homes or seniors housing) is subject to flood related development controls.

(2)

Whether or not development on that land or part of the land for any other purpose is subject to flood related development controls.

(3)

Words and expressions in this clause have the same meanings as in the instrument set out in the Schedule to the Standard Instrument (Local Environmental Plans) Order 2006.
