Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Environmental Planning and Assessment Act 1979.

Explanatory note
The object of this Regulation is to provide that, for development within the area to which Burwood Local Environmental Plan (Burwood Town Centre) 2010 applies, the maximum section 94A levy that may be imposed is:

(a) if the proposed cost of carrying out the development is $250,000 or less, nil, or

(b) if the proposed cost of carrying out the development is more than $250,000, 4 per cent. This Regulation is made under the Environmental Planning and Assessment Act 1979, including sections 94A and 157 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Environmental Planning and Assessment
Amendment (Burwood Town Centre Levies) Regulation 2010.

2      Commencement

This Regulation commences on the date of commencement of the Burwood Local Environmental Plan (Burwood Town Centre) 2010 and is required to be published on the NSW legislation website.

3 Amendment of Environmental Planning and Assessment Regulation 2000
