(Relating to planning for bush fire protection)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Environmental Planning and Assessment Act 1979, has been pleased to make the Regulation set forth hereunder.

The Environmental Planning and Assessment Regulation 1994 is amended by inserting after clause 65 (d) the following paragraph:

(e) the matters set out in the document entitled “Planning for Bush Fire Protection’’ (published by the Department of Bush Fire Services) or in any other publication of that Department published in substitution for that document and approved for the time being by the Director.

EXPLANATORY NOTE

The object of this Regulation is to prescribe the matters set out in the “Planning for Bush Fire Protection” publication of the Bush Fire Services Department (or in any other publication which replaces that publication) as matters that a consent authority must take into consideration in determining a development application under the Environmental Planning and Assessment Act 1979.

This Regulation is made under the Environmental Planning and Assessment Act
1979, including sections 90 (1) (s) and 157 (the general regulation making power).
