ENVIRONMENTAL PLANNING AND ASSESSMENT ACT 1979 -
REGULATION
(Relating to coastal development)

| forth hereunder. |

Commencement
1. This Regulation takes effect on 24 September 1990.
Amendment
2. The Environmental Planning and Assessment Regulation 1980 is amended by omitting clause 41 A and by inserting instead the following clause:
Matters for consideration in determining development applications
41A. For the purpose of section 90 (1) (s) of the Act, the
following matters are prescribed:

whether adequate provision has been made for access to the development, or to the land to which the development application relates, for disabled persons; and
the Government publication entitled "New South Wales
| Coast Government Policy”, as amended from time to time, a copy of which may be inspected by any person during ordinary office hours at any of the offices of the Department of Planning or at the offices of the councils of the following local government areas: |

EXPLANATORY NOTE
The object of this Regulation is to require a consent authority to consider matters
specified in the Government publication "New South Wales Coast Government
Policy" when considering applications to carry out development in certain coastal
areas.
