(Relating to penalty notices for offences under the Noise Control Act 1975)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Environmental Offences and Penalties Act 1989, has k e n pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 September 1995.
Amendments
2. Schedule 2 to the Environmental Offences and Penalties Act 1989 is
amended:
(a)
by inserting after the headings relating to the Noise Control Act 1975 the following matter:

EXPLANATORY NOTE
The object of this Regulation is to update the list of offences under the Noise Control Act 1975 for which penalty notices can be issued. The update is necessitated by the repeal of the Noise Control Regulation 1975 and its replacement by the following regulations:
(a) the Noise Control (General) Regulation 1995;
(b) the Noise Control (Miscellaneous Articles) Regulation 1995;
(c) the Noise Control (Motor Vehicles and Motor Vehicles Accessories) Regulation 1995.
This Regulation is made under the Environmental Offences and Penalties Act 1989, in particular section 8G (penalty notices) and section 28 (the general regulation making power).
