Environmental Management and Pollution Control (General Fees) Amendment Regulations 1998

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Environmental Management and Pollution Control Act 1994 .11 March 1998

1Short titleThese regulations may be cited as the Environmental Management and Pollution Control (General Fees) Amendment Regulations 1998 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Environmental Management and Pollution Control (General Fees) Regulations 1995 are referred to as the Principal Regulations. 4Regulation 3 substituted Regulation 3 of the Principal Regulations is rescinded and the following regulation is substituted: 3Interpretation In these regulations – Act means the Environmental Management and Pollution Control Act 1994 ; permissible level 2 activity has the same meaning as in section 25 of the Act. 5Regulation 6 amended (Payment of fees) Regulation 6 of the Principal Regulations is amended by omitting "Director" and substituting "Board". 6Schedule 1 amended (Fees) Schedule 1 to the Principal Regulations is amended as follows: (a) by inserting in the heading to Part 1 "PERMISSIBLE" before "LEVEL"; (b) by omitting from item 7(b)(ii) in Part 1 "2" and substituting "3"; (c) by omitting from item 7(b)(iii) in Part 1 "less" and substituting "not more"; (d) by inserting in the heading to Part 2 "PERMISSIBLE" before "LEVEL"; (e) by inserting after item 2 of the Annual Fees in Part 2 the following item:

A level 2 activity for which an environment protection notice has been issued under section 27(6)(a)

the same fee as would be payable under Part 1 of Schedule 1 as an annual permit fee for the activity if it were a permissible level 2 activity

(f) by inserting after item 2 of the Assesment Fees in Part 2 the following item:

A level 2 activity assessed by the Board under section 27(1)

the same fee as would be payable under Part 1 of Schedule 1 as an assessment fee for the activity if it were a permissible level 2 activity

(g) by inserting after item 1 in Part 4 the following item:

Annual fee in respect of premises declared to be scheduled premises under section 22A of the repealed Act

(h) by omitting from item 5(a)(ii)(C) in Part 4 "1 and 2" and substituting "(A) and (B)".
