Part 1—Preliminary
1—Short title
These regulations may be cited as the Environment, Resources and Development Court Variation Regulations 2004.
2—Commencement
These regulations will come into operation on 1 July 2004.
3—Variation provisions
In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

4—Substitution of Schedule
Schedule—delete the Schedule and substitute:
Schedule—Fees in general jurisdiction

On filing or lodging any application or initiating any appeal or other proceedings, other than—
(a) an interlocutory application under the rules of the Court; or
(b) an application that relates to a building dispute to which section 86(5) of the Development Act 1993 applies; or
(c) an application to the Court for a consent judgment

On an application by a party to proceedings for the issue of a summons

Note—
As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
