Environment Protection Transitional Further Amendment Regulations 2021

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Environment Protection Transitional Regulations 2021 to further modify the application of the saved Environment Protection (Management of Tunnel Boring Machine Spoil) Regulations 2020.

2Authorising provision

These Regulations are made under section 502 of the Environment Protection Act 2017.

3Regulation 9A amended

(1)In regulation 9A(2)(b) of the Environment Protection Transitional Regulations 2021[1]—

(a)for "44 and 45" substitute "44, 45 and 46";

(b)for "discharge or deposit" substitute "discharge, deposit or disposal".

(2)After regulation 9A(2)(d)(iv) of the Environment Protection Transitional Regulations 2021 insert— 

'(iva)in paragraph (k), for "discharge or deposit" there were substituted "discharge, deposit or disposal"; and'.

(3)In regulation 9A(2)(e) of the Environment Protection Transitional Regulations 2021—

(a)for "discharge or deposit" substitute "discharge, deposit or disposal";

(b)for 'spoil at a premises".' substitute 'spoil at a premises"; and'.

(4)After regulation 9A(2)(e) of the Environment Protection Transitional Regulations 2021 insert—

'(f)in regulation 6(2)(i) of the Spoil Regulations, for "discharge or deposit" there were substituted "discharge, deposit or disposal".'.

4Revocation of these Regulations

These Regulations are revoked on 30 June 2023.
