An Act to amend the Environment Protection Act 1997 and the Environment Protection Regulations
[Notified in ACT Gazette No. 40: 5 October 2000]
The Legislative Assembly for the Australian Capital Territory enacts as follows:
Part 1—preliminary
Name of Act
This Act is the Environment Protection Legislation Amendment Act 2000.
Commencement
This Act commences on a day fixed by the Minister by notice in the Gazette.
Note 1 The provisions of an Act providing for its name and commencement automatically commence on the date of notification of the Act (see Interpretation Act 1967, s 10B).
Note 2 A single day or time may be fixed, or different days or times may be fixed, for the commencement of different provisions (see Interpretation Act 1967, s 10C (1)).
Note 3 If a provision has not commenced within 6 months beginning on the date of notification of the Act, it automatically commences on the first day after that period (see Interpretation Act 1967, s 10E (2)).
Part 2—amendments of the Environment protection act
Act amended
This Part amends the Environment Protection Act 1997.
Schedule 1
Schedule 1 is amended—
(a)by inserting in clause 1 the following definition:
“firewood means wood that is cut and burned for fuel that is taken from—
(a)trees grown for the primary purpose of producing firewood; or
(b)residue from forestry or wood processing operations involving—
(i)native forest timber; or
(ii)plantation timber; or
(c)trees felled or killed to allow for agricultural or building or construction activities; or
(d)trees (live or dead) of a kind not mentioned in paragraphs (a), (b) or (c).”; and
(b)by adding at the end of clause 2 the following paragraph:
“(w)the sale or supply, or cutting, storing or seasoning in preparation for sale or supply, of firewood in the Territory.”.
Part 3—amendments of the environment protection regulations
Regulations amended
This Part amends the Environment Protection Regulations.
Insertion
Before regulation 40 insert the following regulation in Part 8:
“39A Conditions of environmental authorisation—firewood
For subparagraph 51 (a) (viii) of the Act, the following are prescribed standards for an environmental authorisation in relation to an activity mentioned in paragraph 2 (w) of Schedule 1 to the Act with which the applicant for the authorisation must comply:
(a)as far as possible, offer customers the choice of mixed wood loads;
(b)offer and supply firewood by mass (weight) only and not by volume;
(c)give each customer a written statement of the mass (weight) of the load supplied;
(d)if the load is a mixed load—give each customer a written statement stating the approximate mass (weight) of hardwood and softwood in the load;
(e)supply seasoned firewood only;
(f)give each customer a pamphlet supplied by Environment ACT that sets out recommended wood burning practices and that encourages compliance with those practices;
(g)give the following information to each customer to whom firewood is supplied:
(i)the common name and species (if known) or the kind of wood;
Example common name or kind of wood—box, gum, pine.
(ii)the place from which the firewood was originally taken;
Example of locality from which firewood taken—ACT pine forests, Cowra.
(iii)the type of firewood.
Example of type of firewood—residue from forestry processing operations of native forest timber.
