Environment Protection Further Amendment Regulations 2021
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to make minor and technical amendments to the Environment Protection Regulations 2021.
2Authorising provision
These Regulations are made under section 465 of the Environment Protection Act 2017.
3Principal Regulations
In these Regulations, the Environment Protection Regulations 2021[1] are called the Principal Regulations.
4Determinations of the Authority
In regulation 5(3)(a) of the Principal Regulations, after "receiving" insert "and using".
5Prescribed exemptions in relation to permit activities
In regulation 40(2) of the Principal Regulations, in the definition of Class B or C reclaimed wastewater, for "Guidelines for Environmental Management—Use of Reclaimed Water" substitute "Victorian guideline for water recycling".
6Municipal districts subject to higher waste levy for municipal and industrial waste
After regulation 52(s) of the Principal Regulations insert—
"(sa)Maribyrnong;".
7Authorised to receive industrial waste
In regulation 63(b) of the Principal Regulations, after "received" insert "and used".
8Temporary prescribed exemptions—operating activities
In regulation 222(2) of the Principal Regulations omit "the earlier of".
9Temporary prescribed exemptions—permit activities
(1)In regulation 223(3) and (4) of the Principal Regulations omit "the earlier of the following".
(2)In regulation 223(3)(a) and (4)(a) of the Principal Regulations, for "person;" substitute "person; or".
10Schedule 1—Prescribed permission activities and fees
For column 3 of item 15 in the Table in Schedule 1 to the Principal Regulations substitute "Transporting reportable priority waste (transport) including the following waste codes B100, E100, G100 or R100".
11Schedule 10—Infringement offences and infringement penalties
In column 2 of item 33 in the table in Schedule 10 to the Principal Regulations, for "Regulation 64(5)" substitute "Regulation 64(6)".
