  1. Name of Proclamation

This Proclamation is the Environment Protection and Biodiversity Conservation (Commonwealth Marine Reserves) Proclamation 2012.

  1. Commencement

This Proclamation commences on the day after it is registered.

  1. Definitions

In this Proclamation:

Act means the Environment Protection and Biodiversity Conservation Act 1999.

Fisheries Jurisdiction Line means the line described in annex 8 of the Torres Strait Treaty.

Maritime boundary (French Republic) Agreement means the Agreement on Maritime Delimitation between the Government of Australia and the Government of the French Republic, done at Melbourne on 4 January 1982.

Maritime boundary (New Zealand) Treaty means the Treaty between the Government of Australia and the Government of New Zealand Establishing Certain Exclusive Economic Zone Boundaries and Continental Shelf Boundaries, done at Adelaide on 25 July 2004.

Maritime boundary (Solomon Islands) Agreement means the Agreement between the Government of Australia and the Government of Solomon Islands establishing Certain Sea and Seabed Boundaries, done at Honiara on 13 September 1988.

Norfolk Island has the same meaning as Territory in subsection 4 (1) of the Norfolk Island Act 1979.

Protected Zone means the zone established under article 10 of the Torres Strait Treaty.

Note   The Protected Zone is bounded by the line described in annex 9 of the Torres Strait Treaty.

regulations means the Environment Protection and Biodiversity Conservation Regulations 2000.

scheduled area has the same meaning as in section 7 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006.

State waters has the same meaning as coastal waters of the State in subsection 3 (1) of the Coastal Waters (State Powers) Act 1980.

territorial sea baseline means the baseline from which the breadth of the territorial sea is measured under section 7 of the Seas and Submerged Lands Act 1973.

Territory waters has the same meaning as coastal waters of the Territory in subsection 3 (1) of the Coastal Waters (Northern Territory Powers) Act 1980.

Torres Strait Treaty means the Treaty between Australia and the Independent State of Papua New Guinea concerning Sovereignty and Maritime Boundaries in the area between the two Countries, including the area known as Torres Strait, and Related Matters, done at Sydney on 18 December 1978.

Note 1   A number of terms used in this Proclamation are defined in the Act, including:

·      Commonwealth reserve

·      continental shelf

·      exclusive economic zone

·      Great Barrier Reef Marine Park

·      IUCN category

·      territorial sea.

  • Declaration of Commonwealth reserves

  • The areas described in Schedules 1 to 5 are declared to be Commonwealth reserves.

    1. Names of Commonwealth reserves

    For paragraph 346 (1) (a) of the Act, the name of each Commonwealth reserve is the name given for the reserve in Schedules 1 to 5.

    1. Purposes for Commonwealth reserves

    For paragraph 346 (1) (b) of the Act, each Commonwealth reserve mentioned in Schedules 1 to 5 has the following purposes:

    (a)    to protect and maintain biological diversity in the reserve;

    (b)    to contribute to the objectives of the national representative system of marine protected areas.

    Note   The national representative system of marine protected areas (NRSMPA) is an Australian Government marine conservation program that ensures the conservation and sustainable use of Australia’s marine and estuarine environments. Further information about the NRSMPA is available at type="1">

  • Depth of land included in Commonwealth reserves

  • For paragraph 346 (1) (c) of the Act, if a Commonwealth reserve mentioned in Schedules 1 to 5 includes land, the land is included to a depth of 1 000 metres.

    1. Depth of seabed included in Commonwealth reserves

    For paragraph 346 (1) (d) of the Act, each Commonwealth reserve mentioned in Schedules 1 to 5 includes the seabed to a depth of 1 000 metres.

    1. IUCN categories of Commonwealth reserves

    For paragraph 346 (1) (e) of the Act, the IUCN category of each Commonwealth reserve is the IUCN category given for the reserve in Schedules 1 to 5.

    1. Zones of Commonwealth reserves

    For subsection 346 (2) of the Act, if a Commonwealth reserve mentioned in Schedules 1 to 5 is divided into zones:

    (a)    the zones are identified in the Schedule; and

    (b)    each zone is assigned an IUCN category.

    1. Geographic coordinates

    (1)   Geographic coordinates in this Proclamation are expressed in terms of the Geocentric Datum of Australia 1994.

    Note   The Geocentric Datum of Australia 1994 (also known as GDA94) was published in Gazette No. GN 35 of 6 September 1995.

    (2)   However, the geographic coordinates in the following items in tables of this Proclamation are expressed in terms of the Australian Geodetic Datum 1966:

    (a)    item 1 of clause 8.3 of Schedule 3;

    (b)    item 1 of clause 8.5 of Schedule 3;

    (c)    items 1 and 2 of clause 1.3 of Schedule 4;

    (d)    items 1 and 2 of clause 1.5 of Schedule 4;

    Schedule 1        South-west network of Commonwealth Marine Reserves

    (sections 4 to 10)

    Part 1          Southern Kangaroo Island Commonwealth Marine Reserve

    1.1           Name of reserve

    This reserve is the Southern Kangaroo Island Commonwealth Marine Reserve.

    Note   Section 6 states the purposes of the reserve, section 7 states the depth of any land that may be included in the reserve and section 8 states the depth of the seabed included in the reserve.

    1.2           IUCN category

    The Southern Kangaroo Island Commonwealth Marine Reserve is assigned to IUCN category VI (managed resource protected area).

    Note   Regulation 10.03H of the regulations lists each IUCN category and Schedule 8 to the regulations sets out the Australian IUCN reserve management principles for each IUCN category.

    1.3           Area of reserve

       The Southern Kangaroo Island Commonwealth Marine Reserve consists of an area in the Southern Ocean bounded by the line commencing at the point described in item 1 of the following table and running progressively as described in the table.

    2.1           Name of reserve

    This reserve is the Western Kangaroo Island Commonwealth Marine Reserve.

    Note   Section 6 states the purposes of the reserve, section 7 states the depth of any land that may be included in the reserve and section 8 states the depth of the seabed included in the reserve.

    2.2           IUCN category

    The Western Kangaroo Island Commonwealth Marine Reserve is assigned to IUCN category VI (managed resource protected area).

    2.3           Area of reserve

    2.4           Zones for reserve

    (1)   The Western Kangaroo Island Commonwealth Marine Reserve is divided into the following zones:

    (a)    the marine national park zone described in clause 2.5 of this Part;

    (b)    the special purpose zone described in clause 2.6 of this Part.

    (2)   The marine national park zone is assigned to IUCN category II (national park).

    (3)   The special purpose zone is assigned to IUCN category VI (managed resource protected area).

    2.5           Zone 1 of reserve—marine national park zone

       Zone 1 of the reserve consists of an area bounded by the line commencing at the point described in item 1 of the following table and running progressively as described in the table.

    The Western Eyre Commonwealth Marine Reserve is assigned to IUCN category VI (managed resource protected area).

    (3)   The marine national park zones described in clauses 3.6, 3.7 and 3.9 of this Part are each assigned to IUCN category II (national park).

    (4)   The multiple use zone described in clause 3.8 of this Part is assigned to IUCN category VI (managed resource protected area).

    This reserve is the Cod Grounds Commonwealth Marine Reserve.

    Note   Section 6 states the purposes of the reserve, section 7 states the depth of any land that may be included in the reserve and section 8 states the depth of the seabed included in the reserve.

    6.2           IUCN category

    The Cod Grounds Commonwealth Marine Reserve is assigned to IUCN category II (national park).

    6.3           Area of reserve

    The Cod Grounds Commonwealth Marine Reserve consists of an area in the Tasman Sea bounded by the line commencing at the point described in item 1 of the following table and running progressively as described in the table.

    Part 7          Hunter Commonwealth Marine Reserve

    7.1           Name of reserve

    This reserve is the Hunter Commonwealth Marine Reserve.

    Note   Section 6 states the purposes of the reserve, section 7 states the depth of any land that may be included in the reserve and section 8 states the depth of the seabed included in the reserve.

    7.2           IUCN category

    The Hunter Commonwealth Marine Reserve is assigned to IUCN category VI (managed resource protected area).

    7.3           Area of reserve

    The Hunter Commonwealth Marine Reserve consists of an area in the Tasman Sea bounded by the line commencing at the point described in item 1 of the following table and running progressively as described in the table.

    7.4           Zones for reserve

    (1)   The Hunter Commonwealth Marine Reserve is divided into the following zones:

    (a)    the special purpose zone described in clause 7.5 of this Part;

    (b)    the multiple use zone described in clause 7.6 of this Part.

    (2)   The special purpose zone and multiple use zone are each assigned to IUCN category VI (managed resource protection area).

    7.5           Zone 1 of reserve—special purpose zone

    Zone 1 of the reserve consists of an area bounded by the line commencing at the point described in item 1 of the following table and running progressively as described in the table.
