Environment Protection Amendment (Waste Tyres—Silage Production) Regulations 2022

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Environment Protection Regulations 2021—

(a)to prescribe the use of waste tyres for the purpose of silage production as a registration activity for the purposes of section 47 of the Environment Protection Act 2017; and

(b)to prescribe a temporary exemption from registration for that activity; and

(c)to make other minor and technical amendments.

2Authorising provision

These Regulations are made under section 465 of the Environment Protection Act 2017.

3Principal Regulations

In these Regulations, the Environment Protection Regulations 2021[1] are called the Principal Regulations.

4Definitions

In regulation 4 of the Principal Regulations insert the following definitions—

"forage includes residual crops and crops grown for use in silage production;

silage means forage that has been preserved for use as animal feed;

silage production means the anaerobic process of preserving forage to produce silage;".

5New regulation 225 inserted

After regulation 224 of the Principal Regulations insert

"225   Temporary prescribed exemption—registration activities—use of waste tyres for silage production

For the purposes of section 47(2)(c) of the Act, it is a prescribed exemption for a person to whom the Authority has not granted a registration for the activity set out in item 36A (B04—Waste tyres—silage production) in the Table in Schedule 1 to engage in that activity on or before 1 July 2023.".

6Schedule 1 amended

(1)In column 3 of item 13 in the Table in Schedule 1 to the Principal Regulations, after "purpose" insert ", other than for the activity set out in item 36A (B04—Waste tyres—silage production) in this Table".

(2)In item 14 in the Table in Schedule 1 to the Principal Regulations—

(a)in paragraph (b) in column 3, for "regulation 5" substitute "regulation 5; or";

(b)after paragraph (b) in column 3 insert

"(c)  if the waste tyres are used for the activity set out in item 36A (B04—Waste tyres—silage production) in this Table".

(3)After item 36 in the Table in Schedule 1 to the Principal Regulations insert

"36A B04 (Waste tyres—silage production) Using 5 m3 or more of waste tyres as weights during silage production, including storing waste tyres for that purpose ·  Prescribed registration activity".
