Enhancing Online Safety for Children Act 2015

I, MITCH FIFIELD, Minister for Communications, make the following declaration under subsection 30(1) of the Enhancing Online Safety for Children Act 2015.

1  Name of declaration

This declaration is the Enhancing Online Safety for Children (Tier 2 Social Media Services) Declaration 2015.

2  Commencement

This declaration commences on day after it is registered on the Federal Register of Legislative Instruments.

3  Definitions

In this declaration:

Act means Enhancing Online Safety for Children Act 2015.

Note:          A number of expressions used in this declaration are defined in the Act, including the following:

(a)    social media service;

(b)    tier 2 social media service.

4Declared services

Each of the following social media services is declared to be a tier 2 social media service for the purposes of the Act:

(a)    Google +, a social media service provided by Google Inc., having an office at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

(b)   YouTube, a social media service provided by Google Inc., having an office at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

(c)    Facebook, a social media service provided by Facebook Ireland Limited, having an office at 4 Grand Canal Square, Dublin 2, Ireland.

(d)   Instagram, a social media service provided by Instagram, LLC, having an office at 1601 Willow Road, Menlo Park, CA 94025, USA.
