ENERGY SERVICES CORPORATIONS ACT 1995—ORDER

NEW SOUTH WALES

I, PATRICK CARL SCULLY, Acting Minister for Energy, make the following Order under Clause 7 of Schedule 5 to the Energy Services Corporations Act 1995.

Citation

l. This Order may be cited as the Energy Services Corporations

(Transfer of Former Distributors’ Assets) Order 1996.

Commencement

2. This Order commences on 1 March 1996.

Definition

3. In this Order:

“former distributor” means an electricity distributor constituted

under the Electricity Act 1945;

“new distributor” means an energy distributor constituted under the

Energy Services Corporations Act 1995.

Transfer of staff, assets, rights and liabilities generally

4. The staff, assets, rights and liabilities of each former distributor are transferred to the new distributor of the same name, except as provided by Clauses 5 and 6.

Transfer of transmission lines to Transgrid

5. (1) The following assets, rights and liabilities of NorthPower Energy are transferred to TransGrid:

the 132kV transmission line 96F/1 that runs between Kurri and

(a) Stroud;
(b) the 132kV transmission line 96F/2 that runs between Tomago 132 and Tea Gardens;
(c) any interests held by NorthPower Energy in land over which those transmission lines are situated;
(d) any rights and liabilities associated with the assets referred to in paragraphs (a), (b) or (c).

(2) The following assets, rights and liabilities of MetSouth Energy are transferred to TransGrid:

the 132kV transmission line 96Y that runs between Mt Piper and

(a) Mt Piper 132;
(b) the 132kV transmission line 94E therruns* between Mt Piper 132 and Wallerawang 132;
(c) the 132kV transmission line 94M/2 that runs between Mt Piper 132 and 94M Tee;
(d) the 132kV substation situated at Mt Piper 13%; any interests held by MetSouth Energy in land over which those
(e) transmission lines or that substation are situated;
(f) any rights and liabilities associated with the assets referred to in paragraphs (a), (b), (c), (d) or (e).

Exclusion of staff, assets, rights and liabilities relating to water supply functions

6. The staff, assets, rights and liabilities of NorthPower Energy and Energy South, in so far as they relate to the water supply functions of those energy distributors under section 6FB of the Electricity Act 1945, are excluded from the operation of this Order.

Payment to the Treasurer on behalf of the State of New South Wales

7. (1) Each new distributor must pay to the Treasurer on behalf of the State of New South Wales, for payment into the Consolidated Fund, an mount to be determined by the Treasurer.

(2) The amount referred to in Clause 7 (1) of this Order may differ for

each new distributor.

(3) For each new distributor, the Treasurer may require the amount

referred to in Clause 7 (1) to be paid:

(a) in whole, within any time period nominated by the Treasurer;

(b) in instalments of equal or varying amounts, within any time period or periods nominated by the Treasurer for each instalment; and
(c) with interest accruing, at any rate prescribed by the Treasurer, on the whole or any part of that amount for so long as it remains unpaid.
