Explanatory note
The object of this Regulation is to amend Part 1 of Schedule 1 to the Energy Services Corporations Act 1995 so as to constitute a new energy services corporation. The new corporation is to be an electricity generator called Eraring Energy.
This Regulation is made under section 13 of the Energy Services Corporations Act

1995.

Regulation 2000

1     Name of Regulation

This Regulation is the Energy Services Corporations (Eraring Energy)

Regulation 2000.

2 Commencement

This Regulation commences on 1 July 2000, or on the day following the last day on which it is capable of being disallowed under section 41 of the Interpretation Act 1987, whichever is the later.

Note. Pursuant to section 13 (3) of the Energy Services Corporations Act 1995, this Regulation is not capable of being disallowed by either House of Parliament unless the disallowance resolution is passed within 15 sitting days after written notice of the making of the Regulation is laid before that House under section 40 of the Interpretation Act 1987.

3     Constitution of Eraring Energy

Schedule 1 to the Energy Services Corporations Act 1995 is amended by inserting the following corporate name in alphabetical order in Part 1:

Note. On the day on which this Regulation takes effect, section 13 (4) (a) of the Energy Services Corporations Act 1995 will constitute Eraring Energy as a statutory corporation, and section 13 (4) (b) of that Act will amend Schedule 5 to the State Owned Corporations Act 1989 so as include the corporate name of Eraring Energy in that Schedule, as a consequence of which Eraring Energy will become a statutory State owned corporation.
