Energy Resource Consumption Levy (Waiver of Levy) Act 1998

An Act to waive the liability of certain consumers to pay a levy under the Energy Resource Consumption Levy Act

1Short title

This Act may be cited as the Energy Resource Consumption Levy (Waiver of Levy) Act 1998.

2Interpretation

Words used in this Act that are defined in the Energy Resource Consumption Levy Act have the same meaning as in that Act.

3Waiver of levy

• (1)

  This section is to be taken to have come into operation on 1 July 1998.

• (2)

  No levy is payable to the Crown under the Energy Resource Consumption Levy Act on and from the commencement of this section.

• (3)

  Subsection (2) does not affect the liability of a consumer to pay a levy under the Energy Resource Consumption Levy Act that arose before the commencement of this section.

4Certain provisions to have no further effect

• (1)

  On the commencement of this section, the following provisions of the Energy Resource Consumption Levy Act are of no effect:

  • (a)

    section 6;

  • (b)

    section 7;

  • (c)

    section 8;

  • (d)

    section 10.

• (2)

  The Commissioner may direct a consumer to comply with a section of the Energy Resource Consumption Levy Act referred to in subsection (1) to enable the levy that the consumer may be liable to pay under that Act to be calculated.

• (3)

  A consumer who is given a direction under subsection (2) must not contravene or fail to comply with the direction.

  Penalty:          $1,000.
