Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Energy and Utilities Administration Act 1987.

Explanatory note
The object of this Regulation is to amend the Energy and Utilities Administration Regulation
2006:
| (a) | to introduce minimum energy performance requirements for televisions (which require registration and labelling with an energy efficiency label), and |
| (b) | to introduce minimum energy performance requirements for incandescent lamps and compact fluorescent lamps (which require registration but not labelling with an energy efficiency label), and |
| (c) | to require an application for registration of electrical equipment to be accompanied by the results of testing and calculation only if the relevant standard requires those tests and calculations to accompany the application. |
The amendments made by this Regulation commence as follows:
| (a) | the amendments relating to applications for registration and requirements for televisions commence on 2 October 2009, |
| (b) | the amendments relating to general lighting service incandescent lamps, extra low voltage halogen non-reflector incandescent lamps and compact fluorescent non-reflector lamps commence on 1 November 2009, |
| (c) | the amendments relating to candle, fancy round and decorative incandescent lamps with a power consumption greater than 40W, mains voltage halogen non-reflector incandescent lamps (except lamps with a G9 base) and extra low voltage halogen reflector incandescent lamps commence on 1 October 2010, |

This Regulation is made under the Energy and Utilities Administration Act 1987, including section 38 (Testing and labelling of appliances) and section 53 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Energy and Utilities Administration Further Amendment (Minimum Energy Performance Standards) Regulation 2009.
2 Commencement
(1) This Regulation commences on 2 October 2009, except as provided by
subclauses (2)–(5).(2) Schedule 2 commences on 1 November 2009. (3) Schedule 3 commences on 1 October 2010. (4) Schedule 4 commences on 1 October 2011. (5) Schedule 5 commences on 1 October 2012. (6) This Regulation is required to be published on the NSW legislation
website.

[1] Clause 6 Applications for registration
Omit clause 6 (2) (d). Insert instead:
(d) be accompanied by:
(i) if the relevant standard requires the results of testing and calculations to accompany the application— those results, and (ii) a sample of the energy efficiency label required to be displayed under clause 16, and
(iii) a fee of $150.

The following are the relevant standards for televisions:

[1] Clause 3 Definitions
Insert in appropriate order in clause 3 (1):
exempt equipment means any of the following:
(a) a fluorescent lamp ballast, (b) a power transformer, (c) a refrigerated display cabinet, (d) a rotating electrical machine (3 phase), (e) an external power supply, (f) a digital television set-top box, (g) a commercial building chiller, (h) a close control airconditioner, (i) a general lighting service incandescent lamp,
(j) an extra low voltage halogen non-reflector incandescent lamp, (k) a compact fluorescent non-reflector lamp.
[2] Clause 15 Approval of energy efficiency label
Omit clause 15 (2). Insert instead:
(2) The Corporation may approve an energy efficiency label for any electrical equipment listed in Schedule 2 that it registers, unless it is exempt equipment.
[3] Clause 18 Labels on certain electrical equipment listed in Schedule 2 to be approved
Omit clause 18 (1). Insert instead:
(1) This clause applies to electrical equipment listed in Schedule 2,
but does not apply to exempt equipment.

[4] Schedule 2 Standards for electrical equipment that requires registration but not labelling with an energy efficiency label
Insert after clause 11:
12 Incandescent lamps (1) The following are the relevant standards for prescribed
incandescent lamps:
(a)
AS/NZS 4934.1(Int):2008, Incandescent lamps for general lighting service, Part 1: Test methods—Energy performance,
(b)
AS/NZS 4934.2(Int):2008, Incandescent lamps for general lighting services, Part 2: Minimum Energy Performance Standards (MEPS) requirements.
(2) In this clause:
prescribed incandescent lamp means any of the following:
(a) a general lighting service incandescent lamp, (b) an extra low voltage halogen non-reflector incandescent lamp. 13 Compact fluorescent non-reflector lamps
The following are the relevant standards for compact fluorescent non-reflector lamps:
(a)
AS/NZS 4847.1(Int):2008, Self-ballasted lamps for general lighting services, Part 1: Test methods—Energy performance,
(b)

(l) a candle, fancy round and decorative incandescent lamp with a power consumption greater than 40W, (m) a mains voltage halogen non-reflector incandescent lamp (except a lamp with a G9 base), (n) an extra low voltage halogen reflector incandescent lamp.
