Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Energy and Utilities Administration Act 1987.

Explanatory note
The objects of this Regulation are as follows:

(a) to update references to the minimum energy performance standards for televisions,
(b) to update references to the minimum energy performance standards for compact fluorescent non-reflector lamps,
(c) to introduce minimum energy performance standards and registration requirements for gas water heaters and transformers and electronic step-down convertors for extra low voltage lamps,
(d) to exempt gas water heaters and transformers and electronic step-down convertors for extra low voltage lamps from the requirement to display an approved energy efficiency label,
(e) to include transformers and electronic step-down convertors for extra low voltage lamps labelled with the text “high efficiency” as equipment that cannot be sold unless the equipment satisfies the “high efficiency” requirements of the relevant standard.

The changes will not apply to equipment manufactured in or imported into Australia before sections 38 and 53 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Energy and Utilities Administration Amendment
(Minimum Energy Performance Standards) Regulation 2011.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

[1]      Clause 3 (1) and (4), Part 2, heading, clauses 4, 5, 6 (1)–(4), 7 (1), 8 (2), 9, 11, 12 (1), 14 (1), 15 (1) and (2), 16 (1), 17, 18, 21 (1) and (2), 22, 23, 24, Schedules 1 and 2 (headings)

Omit “electrical equipment” and “Electrical equipment” wherever occurring.

Insert instead “electrical or gas equipment” or “Electrical or gas equipment”, respectively.

[2]      Clause 3 (1), definition of “exempt equipment”

Insert after paragraph (m):

(m1) a gas water heater,
(m2) a transformer and electronic step-down convertor for an
extra low voltage lamp,

[3]      Clause 20 Sale of certain equipment listed in Schedule 2 and labelled as “high efficiency”

Omit clause 20 (1). Insert instead:

(1) This clause applies to a power transformer, refrigerated display cabinet (electrical), rotating electrical machine (three phase), external power supply (electrical), digital television set-top box or transformer or electronic step-down convertor for an extra low voltage lamp.

Insert “(electrical)” at the end of the heading to clause 4.

Omit the clause. Insert instead:

[6]      Schedule 2 Standards for electrical or gas equipment that requires registration but not labelling with an energy efficient label

Insert “(electrical)” at the end of the headings to clauses 5, 7, 8 and 10.

Omit clause 13. Insert instead:

13 Compact fluorescent non-reflector lamps

The following are the relevant standards for compact fluorescent non-reflector lamps:

(a) AS/NZS 4847.1:2010, Self ballasted lamps for general lighting services, Part 1: Test methods—Energy performance,
(b) AS/NZS 4847.2:2010, Self ballasted lamps for general lighting services, Part 2: Minimum Energy Performance Standards (MEPS) requirements.

14      Gas water heaters

The following are the relevant standards for gas water heaters:

(a) AS 4552—2005, Gas fired water heaters for hot water supply and/or central heating,
(b) AS/NZS 4552.2:2010, Gas fired water heaters for hot water supply and/or central heating, Part 2: Minimum energy performance standards for gas water heaters.

15      Transformers and electronic step-down convertors for extra low voltage lamps

The following are the relevant standards for transformers and electronic step-down convertors for extra low voltage lamps:

(a) AS/NZS 4879.1:2008, Performance of transformers and electronic step-down convertors for ELV lamps, Part 1: Test method—Energy performance,
