His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Energy and Utilities Administration Act 1987.

Explanatory note
The object of this Regulation is to introduce mandatory minimum energy performance standards (MEPS) requirements for external power supplies, digital set-top boxes and commercial building chillers. The requirements apply to external power supplies and digital set-top boxes from the day on which this Regulation is published on the NSW legislation website. The requirements apply to commercial building chillers from 1 July 2009.

This Regulation is made under the Energy and Utilities Administration Act 1987, including section 53 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Energy and Utilities Administration Amendment
(Minimum Energy Performance Standards) Regulation 2009.

2      Commencement

(1) This Regulation commences on the day on which it is published on the
NSW legislation website, except as provided by subclause (2).
(2) Schedule 2 to this Regulation commences on 1 July 2009.

[1]      Clause 15 Approval of energy efficiency label

Omit “or rotating electrical machine (three phase)” from clause 15 (2).

Insert instead “, rotating electrical machine (three phase), external power supply or digital television set-top box”.

[2]      Clause 18 Labels on certain electrical equipment listed in Schedule 2 to be approved

Omit “and rotating electrical machines (three phase)” from clause 18 (1).

Insert instead “, rotating electrical machines (three phase), external power supplies and digital television set-top boxes”.

[3]      Clause 20 Sale of certain equipment listed in Schedule 2 and labelled as “high efficiency”

Omit “or rotating electrical machine (three phase)” from clause 20 (1).

Insert instead “, rotating electrical machine (three phase), external power supply or digital television set-top box”.

[4]      Schedule 2 Standards for electrical equipment that requires registration but not labelling with an energy efficiency label

Insert after clause 7:

8      External power supplies

The following are the relevant standards for external power supplies:

(a) AS/NZS 4665.1:2005, Performance of external power supplies, Part 1: Test method and energy performance mark,
(b) AS/NZS 4665.2:2005, Performance of external power supplies, Part 2: Minimum energy performance standard (MEPS) requirements.

9      Digital television set-top boxes

The following are the relevant standards for digital television set-top boxes:

(a)

(b) AS/NZS 4776.1.2:2008, Liquid-chilling packages using the vapour compression cycle, Part 1.2: Method of rating and testing for performance–Testing,
(c) AS/NZS 4776.2:2008, Liquid-chilling packages using the vapour compression cycle, Part 2: Minimum energy performance standard (MEPS) and compliance requirements.
