Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Energy and Utilities Administration Act 1987.

Explanatory note

The object of this Regulation is to introduce mandatory minimum energy performance sections 38 and 53 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Energy and Utilities Administration Amendment
(Close Control Airconditioners) Regulation 2009.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

[1]      Clause 15 Approval of energy efficiency label

Omit “or commercial building chiller” from clause 15 (2).
Insert instead “, commercial building chiller or close control airconditioner”.

[2]      Clause 18 Labels on certain electrical equipment listed in Schedule 2 to be approved

Omit “and commercial building chillers” from clause 18 (1).

Insert instead “, commercial building chillers and close control airconditioners”.

[3]      Schedule 2 Standards for electrical equipment that requires registration but not labelling with an energy efficiency label

Insert after clause 10:

11 Close control airconditioners

The following are the relevant standards for close control airconditioners:

(a) AS/NZS 4965.1:2008, Performance of close control airconditioners, Part 1: Testing for rating,
(b) AS/NZS 4965.2:2008, Performance of close control airconditioners, Part 2: Minimum energy performance standard (MEPS) requirements.
