ENERGY ADMINISTRATION ACT 1987—REGULATION

(Relating to contributions to the State Energy Research and Development

Fund)

HIS Excellency the Governor, with the advice of the Executive Council,

and in pursuance of the Energy Administration Act 1987, has been

pleased to make the Regulation set forth hereunder.

The Energy Administration (General) Regulation 1987 is amended by

inserting after clause 5 the following clause:

Contributions to State Energy Research and Development Fund—

exempt sales

6. (1) The following classes of sales are exempt from the operation

of section 35B of the Act:

(a) the sale of gas for delivery and consumption outside the State;

(b)

the sale of gas to a person who is engaged in the reticulation of gas in the course of intrastate trade (being trade carried on in the State which is not trade or commerce among the States within the meaning of section 92 of the Constitution of the

Commonwealth)

(2) Expressions used in this clause have the same meanings as in the

Gas Act 1986.

EXPLANATORY NOTE

Section 35B of the Energy Administration Act 1987 requires certain persons to pay an annual contribution to the State Energy Research and Development Fund equal to a percentage of revenue from the sale of gas by them during the year (other than any sale of gas prescribed as exempt).

The object of this Regulation is to prescribe classes of sales of gas as exempt.
