Endangered Species Protection Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Endangered Species Protection Act 1992.

1.   Amendment

1.1   The Endangered Species Protection Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 5 (Nominations of ecological communities)

2.1   Paragraph 5 (b):

Omit the paragraph, substitute:

  • “(b)

    a description of the ecological community that is sufficient to distinguish it from any other ecological community by reference to:

    • (i)

      its biological and non-biological components; and

    • (ii)

      if the processes by which those components interact are known—those processes;”.

2.2   Paragraph 5 (d)

After “criteria”, insert “(if any)”.

2.3   Paragraph 5 (f):

Omit the paragraph, substitute:

  • “(f)

    the known current distribution of the ecological community, and a known past distribution, or a reliably-based estimate of the past distribution, of that community;”.
