REGULATIONS UNDER THE DEFENCE ACT 1903-18.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-18, to come into operation as from the 27th day of September, 1923, except where otherwise stated.

REGULATIONS UNDER THE DEFENCE ACT 1903-18.

Regulations for the Employment of Persons in a Civil Capacity in Connexion with the Department of Defence.

Amendment.

Regulation 40a is amended as follows:—

Sub-regulation (1) is amended by deleting paragraphs (a), (b), (d), and (e).

Sub-regulation (2) is cancelled, and the following inserted in lieu thereof:—

“(2). It shall be the duty of each officer or employee who is in receipt of allowance under the provisions of paragraph (c) of sub-regulation (1) of this regulation, immediately to notify the Chief Officer in the event of his becoming ineligible under the prescribed conditions for the payment of allowance or any portion thereof.”

Sub-regulation 2 (a) is amended by deleting the words “Table “B”, and inserting in lieu thereof “Table” A.”

Sub-regulation 3 is cancelled.

Regulation 74 (1) is cancelled, and the following inserted in lieu thereof:—

Classification of Employees—General Division.

74 (1). The classification of employees of the General Division shall be as follows, with limits of pay as shown therein:—

* Increments will be granted annually, except in cases marked “*’’, where advancement will be as determined from time to time by the Secretary.

The-minimum and maximum rates shown indicate the limits of pay for each position, and the amount of increment shown is the amount which ordinarily will be granted, but in special circumstances an employee may be paid at any rate of pay within the limits prescribed for his position.

 

Regulation 74 (2) is cancelled, and the following new regulation inserted in lieu thereof:—

“74 (2). Notwithstanding anything contained in this regulation, the rate determined by an Arbitration Court, Public Service Arbitrator, or Wages Board, to be paid for similar employment in the locality of employment, shall be paid in such office upon the approval of the Secretary.”

 

Provided that the Secretary may grant a rate in excess of that determined by the Arbitration Court, Public Service Arbitrator, or Wages Board, where the Secretary considers a higher rate is warranted because of special skill, general efficiency, or long service.”

Regulation 74 (3) is amended by deleting the words “Table “B”, and inserting in lieu thereof the words “Table ‘A’”.

Regulation 74 (4) is cancelled.

Regulation 74 (5) is cancelled.

Regulation 75 is cancelled, and the following new regulation inserted in lieu thereof:—

“75. Notwithstanding the maximum rate of salary prescribed for Male Senior Assistants in Table “A” of Regulation 74 Male Senior Assistants who are performing clerical duties which, in the opinion of the Secretary, warrant a higher salary than such minimum rate, may, on the approval of the Secretary, be paid a salary not exceeding £272 per annum.

Regulation 76 (1) is cancelled, and the following new regulation is inserted in lieu thereof:—

Minimum Salary.

76 (1). Every employee of the General Division who has attained the age of twenty-one years shall be entitled to receive a salary of at least £195 per annum, provided that a married employee of any age shall receive a salary of not less than £208 per annum.

Regulation 76 (2) is amended by deleting the figures “£138” and “£156”, and inserting in lieu thereof the figures “£195” and “£208”, and by deleting the words “Table ‘B’”, and inserting in lieu thereof the words “Table’ A’”.

Regulation 77 (1) is amended by deleting the words “Chief Officer”, and inserting in lieu thereof the word “Secretary”.

Regulation 79 is cancelled.

Regulation 80 is amended by deleting the words and figures “within Grades III. and IV.”.

Regulation 94 (2) is cancelled, and the following new regulation is inserted in lieu thereof:—

Regulation 94 (7) is amended by deleting the figures “£138” and “£156”, and inserting in lieu thereof the figures “£195”, and “£208”.

Regulations 99 to 104 inclusive are cancelled, with effect from 18th July 1923.

Regulation 106a is cancelled with effect from 18th July, 1923.

Regulation 109a (1) and sub-regulations 2, 3, and 4 are cancelled, with effect from 18th July, 1923.
