Emergency Services Regulations Amendment (Workers Compensation) Regulations 2024

Made by the Governor in Executive Council.

Part 1Preliminary1.Citation

These regulations are the Emergency Services Regulations Amendment (Workers Compensation) Regulations 2024.

2.Commencement

These regulations come into operation as follows —

  • (a)

    Part 1 — on the day on which these regulations are published on the WA legislation website;

  • (b)

    the rest of the regulations — on 1 July 2024.

Part 2Bush Fires Regulations 1954 amended3.Regulations amended

This Part amends the Bush Fires Regulations 1954.

4.Regulation 40 deleted

Delete regulation 40.

Part 3Fire Brigades Regulations 1943 amended5.Regulations amended

This Part amends the Fire Brigades Regulations 1943.

6.Regulation 132 amended
  • (1)

    In regulation 132(1):

    • (a)

      delete “Workers’ Compensation and Injury Management Act 1981,” and insert:

       

    Workers Compensation and Injury Management Act 2023,

     
    • (b)

      delete “weekly amount received as compensation under the Workers’ Compensation and Injury Management Act 1981,” and insert:

       

    income compensation (calculated as a weekly amount) received under the Workers Compensation and Injury Management Act 2023,

     
  • (2)

    In regulation 132(3) delete “weekly payments under the Workers’ Compensation and Injury Management Act 1981” and insert:

     

income compensation under the Workers Compensation and Injury Management Act 2023

  • (3)

    In regulation 132(4) delete “Workers’ Compensation and Injury Management Act 1981 Schedule 2.” and insert:

     

Workers Compensation and Injury Management Act 2023 Part 2 Division 7.

7.Regulation 190 amended
  • (1)

    In regulation 190(1):

    • (a)

      delete “Workers’ Compensation and Injury Management Act 1981” (1st occurrence) and insert:

       

    Workers Compensation and Injury Management Act 2023

     
    • (b)

      delete “Workers’ Compensation and Injury Management Act 1981,” and insert:

       

    Workers Compensation and Injury Management Act 2023,

     
    • (c)

      delete “prescribed amount.” and insert:

       

    general maximum amount.

     
    • (d)

      in paragraphs (a) and (c) delete “13” and insert:

    • (e)

      in paragraph (c) delete “Workers’ Compensation and Injury Management Act 1981 Schedule 2.” and insert:

       

    Workers Compensation and Injury Management Act 2023 Part 2 Division 7.

     
  • (2)

    In regulation 190(2) delete the definition of prescribed amount and insert:

     

general maximum amount means the amount that, during the period of incapacity referred to in that subregulation, is the general maximum amount under the Workers Compensation and Injury Management Act 2023.
