Part 1—Preliminary

1—Short title

These regulations may be cited as the Emergency Management (Expiation Notices) Variation Regulations 2020.

2—Commencement

These regulations come into operation on the day on which they are made.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

4—Insertion of regulation 6

After regulation 5 insert:

6—Authorised officers may give expiation notices

(1)Subject to the Expiation of Offences Act 1996, an authorised officer is authorised to give expiation notices for alleged offences against section 28 of the Act.

(2)The expiation fee for an offence against section 28 of the Act is fixed at—

(a)in the case of a natural person—$1 000; or

(b)in the case of a body corporate—$5 000.

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
