Emergency Management (Critical Infrastructure Resilience) Regulations 2015

1Objective

The objective of these Regulations is to make provision for the purposes of Part 7A of the Emergency Management Act 2013 for—

(a)the preparation of an emergency risk management plan; and

(b)the development, conduct and evaluation of an exercise; and

(c)the conduct of an audit; and

(d)any other matter necessary to be provided for in respect of that Part.

2Authorising provisions

These Regulations are made under sections 76 and 76A of the Emergency Management Act 2013.

3Commencement

These Regulations come into operation on 1 July 2015.

4Definition

In these Regulations, the Act means the Emergency Management Act 2013.

5Emergency risk management plan

For the purposes of section 74P of the Act an emergency risk management plan must be prepared in accordance with the following—

(a)AS/NZS ISO 31000:2009 Risk management—Principles and guidelines, as published from time to time;

(b)SA/SNZ HB 436:2013 Risk management guidelines—Companion to AS/NZS ISO 31000:2009, as published from time to time.

6Conduct of an exercise

For the purposes of section 74Q of the Act an exercise must be developed, conducted and evaluated in accordance with the Australian Emergency Management Handbook Series—Managing Exercises Handbook 3 by the Australian Emergency Management Institute, as published from time to time.

7Conduct of an audit

For the purposes of section 74S of the Act an audit must be conducted in accordance with HB 158—2010 Delivering assurance based on International Standard ISO 31000:2009 Risk management—Principles and guidelines, as published from time to time.

The Emergency Management (Critical Infrastructure Resilience) Regulations 2015, S.R. No. 82/2015 were made on 30 June 2015 by the Governor in Council under sections 76 and 76A of the Emergency Management Act 2013, No. 73/2013 and came into operation on 1 July 2015: regulation 3.

The Emergency Management (Critical Infrastructure Resilience) Regulations 2015 will sunset 10 years after the day of making on 30 June 2025 (see section 5 of the Subordinate Legislation Act 1994).
