  1. An extension of time is necessary to enable this application for special leave to appeal to proceed. The appeal foreshadowed by the application would relate to an order for costs, and would not turn upon the resolution of any question of principle of general importance such as would warrant the grant of special leave to appeal. In addition, the application identifies no reason to doubt the correctness of the decision of the Court of Appeal of the Supreme Court of New South Wales. The application for special leave should, therefore, be refused. That being so, it would be futile to grant an extension of time.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
