  1. An extension of time is necessary to allow this application for special leave to appeal to proceed. The application does not identify any reason to conclude that the applicant was denied a fair and impartial hearing in the Court of Appeal of the Supreme Court of New South Wales. Nor does the application identify any other basis on which the foreshadowed appeal has any prospect of success. The application should, therefore, be refused. That being so, it would be futile to grant an extension of time.
