Electronic Transactions Regulations 2001

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Electronic Transactions Act 2000 .14 May 2001

1Short titleThese regulations may be cited as the Electronic Transactions Regulations 2001 . 2CommencementThese regulations take effect on the day on which the Electronic Transactions Act 2000 commences. 3InterpretationIn these regulations – Act means the Electronic Transactions Act 2000 ; enduring guardian has the same meaning as in the Guardianship and Administration Act 1995 . 4Section 5(1) of Act not to apply to certain transactions Section 5(1) of the Act does not apply to – (a) a transaction by which a will, codicil or any other testamentary instrument is created, executed or revoked; or (b) a transaction by which an instrument is created appointing an enduring guardian or appointing an attorney to manage a person’s affairs; or (c) a transaction required to be effected only by personal service; or (d) the Corporations Law of Tasmania. 5Division 2 of Part 2 of Act not to apply to certain requirements and permissions Division 2 of Part 2 of the Act does not apply to – (a) a requirement or permission relating to the creation, execution or revocation of a will, codicil or other testamentary instrument; or (b) a requirement or permission relating to enduring guardians or powers of attorney; or (c) a requirement that information or a document be delivered only by personal service; or (d) the Corporations Law of Tasmania.
