I, the Attorney General, in pursuance of clause 3 of Schedule 1 to the Electronic Transactions Act

2000, make the following Order.

Explanatory note
The objects of this Order are:

(a)

to authorise the use of JusticeLink for certain purposes in connection with civil and criminal proceedings in the Land and Environment Court and the Industrial Relations Commission (including the Industrial Court), and

(b)

to authorise the use of e-Court in proceedings in all classes of the jurisdiction of the Land and Environment Court, and

(c)

to authorise the use of Online Registry for certain purposes in connection with civil and criminal proceedings in the Land and Environment Court and the Industrial Relations Commission (including the Industrial Court).

This Order is made under clause 3 of Schedule 1 to the Electronic Transactions Act 2000.

1      Name of Order

This Order is the Electronic Transactions (ECM Courts) Amendment (Land and
Environment Court and Industrial Relations Commission) Order 2016.

2      Commencement

This Order commences on the day on which it is published on the NSW legislation website.

Schedule 1 Amendment of Electronic Transactions (ECM
Courts) Order 2005

[1]      Schedule 1 Authority to use JusticeLink

Insert after the matter relating to the Supreme Court in Columns 1 and 2, respectively:

Land and Environment Court  Use in proceedings in Class 1, 2, 3, 4 or 8 of the Land and
Environment Court’s jurisdiction, but only so as:
(a) to enable documents to be filed, issued, used and served in electronic form, and
(b) to enable parties to the proceedings to communicate in electronic form with the Court in connection with any business of the Court that is being conducted in the absence of the public.

Use in proceedings in Class 5, 6 or 7 of the Land and Environment Court’s jurisdiction, but only so as to enable documents to be filed, issued, used and served in electronic form.

Industrial Relations Commission Use in proceedings in the Industrial Relations Commission,
(including the Industrial Court) but only so as:
(a) to enable documents to be filed, issued, used and served in electronic form, and
(b) to enable parties to the proceedings to communicate in electronic form with the Commission in connection with any business of the Commission that is being conducted in the absence of the public.

[2]      Schedule 3 Authority to use e-Court

Omit “Class 1, 2, 3 or 4” from Column 2 of the matter relating to the Land and Environment
Court.

Insert instead “all classes”.

[3]      Schedule 5 Authority to use Online Registry

Insert after the matter relating to the Supreme Court in Columns 1 and 2, respectively:

Land and Environment Court

(a)
