Electronic Transactions (ECM Courts) Amendment (Civil Matters) Order 2014

under the

Electronic Transactions Act 2000

I, the Attorney General, in pursuance of clauses 2 and 3 of Schedule 1 to the Electronic
Transactions Act 2000, make the following Order.

Explanatory note
The objects of this Order are:

(a) to establish Online Registry as an electronic case management system, and

(b)

to authorise the use of Online Registry in civil proceedings in the Supreme Court, District Court and Local Court:

(i) to create, file, issue, use and serve documents in electronic form, and

(ii)

to enable parties to the proceedings to communicate in electronic form with other parties to the proceedings and with the court, and

(iii)

to enable information concerning the progress of the proceedings to be provided in electronic form to parties to the proceedings and to members of the public generally.

This Order is made under clauses 2 and 3 of Schedule 1 to the Electronic Transactions Act 2000.

1      Name of Order

This Order is the Electronic Transactions (ECM Courts) Amendment (Civil Matters)
Order 2014.

2      Commencement

This Order commences on the day on which it is published on the NSW legislation website.

Schedule 1 Amendment of Electronic Transactions (ECM
Courts) Order 2005

[1]      Clause 3 Definitions

Insert in alphabetical order in clause 3 (1):

Online Registry means the electronic case management system of that name that has been established under clause 2 of Schedule 1 to the Act.

Insert after clause 7:

8      Authority to use Online Registry

Pursuant to clause 3 of Schedule 1 to the Act, Online Registry is authorised to be used by any court specified in Column 1 of Schedule 5 for any purpose specified in Column 2 of that Schedule in relation to that court.
