Electronic Conveyancing National Law (Tasmanian Participation Rules) Rules 2023

I make the following rules under section 23 of the Electronic Conveyancing National Law (Tasmania) .29 November 2023

1Short titleThese rules may be cited as the Electronic Conveyancing National Law (Tasmanian Participation Rules) Rules 2023. 2CommencementThese rules take effect on the day on which their making is notified in the Gazette. 3Interpretation (1)  In these rules – Act means the Electronic Conveyancing National Law (Tasmania); and model participation rules means the model participation rules from time to time developed and published by ARNECC within the meaning of the Act. (2)  Unless the contrary intention appears, a word or expression used in these rules that is also used in the Electronic Conveyancing (Adoption of National Law) Act 2013 has the same meaning in these rules as it has in that Act. 4Tasmanian participation rules (1) For the purposes of section 23 of the Act, the participation rules determined under that section, for the purposes of the Act, are the rules set out in the model participation rules. (2)  The participation rules determined under subrule (1) take effect 20 business days after the participation rules are published by the Registrar on a public website maintained by, or on behalf of, the Department. 5Substitution of model participation rulesFor the purposes of the Act, any substitution, published by ARNECC within the meaning of the Act, of the model participation rules – (a) is taken to be a substitution of the participation rules determined under rule 4; and (b) is determined to be participation rules under section 23 of the Act in accordance with rule 4 as so substituted; and (c) takes effect 20 business days after the substituted participation rules are published by the Registrar on a public website maintained by, or on behalf of, the Department. 6Publication of draft does not constitute publication of rulesFor the avoidance of doubt, publication by the Registrar of a consultation or exposure draft of the participation rules does not constitute publication for the purposes of these rules.
