REGULATION

(Electricity Transmission Authority (Savings and Transitional) Regulation 1995)

HIS Excellency the Governor, with the advice of the Executive Council. and in pursuance of the Electricity Transmission Authority Act 1994, has been pleased to make the Regulation set forth hereunder.

Citation

1. This Regulation may be cited as the Electricity Transmission Authority (Savings and Transitional) Regulation 1995.

Commencement

2. This Regulation commences on 1 February 1995.

Saving of existing ELCOM delegations

3. (1) Any delegation by ELCOM in force immediately before the commencement of the Electricity Transmission Authority Act 1994 is taken to be a delegation by the Authority under that Act to the extent that the delegation by ELCOM:

(a) relates to functions that become functions of the Authority on that commencement; and

(b) could be effected by the Authority as a delegation under that Act.

(2) Such a delegation by ELCOM may be revoked wholly or partly by the Authority as delegator (to the extent that it is taken to be a delegation by the Authority).

(3) This clause does not affect any continuing operation that a delegation may have as a delegation by ELCOM (in relation to functions that remain functions of ELCOM after that commencement).

EXPLANATORY NOTE

The object of this Regulation is to make it clear that any existing delegations by the Electricity Commission of functions that have been transferred to the new Electricity Transmission Authority (by virtue of the commencement on 1 February 1995 of the Electricity Transmission Authority Act 1994) are continued in force until revoked by the new Authority.

The Regulation comprises matters of a savings or transitional nature and is made

under clause 2 of Schedule 2 to the Electricity Transmission Authority Act 1994.
