Electricity Supply Industry (Price Control) Amendment Regulations 2007

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Electricity Supply Industry Act 1995 .17 September 2007

1Short titleThese regulations may be cited as the Electricity Supply Industry (Price Control) Amendment Regulations 2007 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Electricity Supply Industry (Price Control) Regulations 2003 are referred to as the Principal Regulations. 4Regulation 3 amended (Interpretation) Regulation 3 of the Principal Regulations is amended by inserting after the definition of provide the following definition: regional reference node has the same meaning as in the National Electricity Rules; 5Regulation 32 amended (Principles to be given effect) Regulation 32 of the Principal Regulations is amended by omitting subregulations (3) and (4) and substituting the following subregulation: (3)  In making a declared electrical service price determination relating to a declared electrical service that is or includes a retail service provided by Aurora Energy for non-contestable customers on mainland Tasmania, the Regulator is to assume that the price that Aurora Energy pays for all of the electricity used for that retail service during a period is equal to the price specified in respect of that period in column 3 of Schedule 2 . 6Schedule 2 insertedAfter Schedule 1 to the Principal Regulations , the following Schedule is inserted: Schedule 2Assumed Electricity Price

EXPLANATORY NOTE

(This note is not part of the regulation) These regulations amend the

(a) requiring the Regulator, in making a price determination relating to a retail service, to assume that Aurora Energy pays the price specified in the Electricity Supply Industry (Price Control) Regulations 2003 for all the electricity it uses for that retail service; and (b) specifying that price.
