Electricity Supply Industry Amendment Regulations 2010

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Electricity Supply Industry Act 1995 .11 February 2010

1Short titleThese regulations may be cited as the Electricity Supply Industry Amendment Regulations 2010 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Electricity Supply Industry Regulations 2008 are referred to as the Principal Regulations. 4Regulation 4 amended (Circumstances in which licence not required) Regulation 4 of the Principal Regulations is amended as follows: (a) by omitting paragraph (e) from subregulation (3) and substituting the following paragraph: (e) Tasmanian Ports Corporation Pty Ltd (ACN 114 161 938) for the sale of electricity distributed by the Corporation through a distribution network installed and operated by the Corporation before 1 January 2010. (b) by inserting the following subregulation after subregulation (3) : (4)  A licence authorising the distribution of electricity is not required by the Tasmanian Ports Corporation Pty Ltd (ACN 114 161 938) for electricity distributed by the Corporation through a distribution network installed and operated by the Corporation before 1 January 2010. 5Regulations 10 and 11 insertedAfter regulation 9 of the Principal Regulations , the following regulations are inserted: 10Authorisation of electricity supply line For section 111(3)(b) of the Act, Tasmanian Ports Corporation Pty Ltd (ACN 114161938) is authorised to run an electricity supply line beyond the boundaries of property occupied by the Corporation, if the supply line as so run formed, before 1 January 2010, part of the distribution network operated by the Corporation. 11Expiry of certain regulations Regulation 4(3)(e) , regulation 4(4) and regulation 10 expire on 31 December 2011.
