SOUTH AUSTRALIA

ELECTRICITY SUPPLY (INDUSTRIES) ACT, 1963

An Act to enable The Electricity Trust of South Australia to supply electricity on special

terms for the promotion and development of industry and for other purposes.

BE IT ENACTED by the Governor of the State of South Australia, with the advice and consent of the Parliament thereof, as follows:

Short title

1. This Act may be cited as the Electricity Supply (Industries) Act, 1963.

Interpretation

2. In this Act—

"approved industry" means an industry or industrial undertaking declared to be an approved

industry under section 3.

"the Trust" means The Electricity Trust of South Australia.

Power to declare approved industries

3. If the Treasurer, after obtaining the advice of the Trust, is of the opinion that it is desirable to promote or encourage the establishment or expansion or maintenance of any industry or industrial undertaking, the Treasurer may declare any such industry or industrial undertaking to be an approved industry for the purposes of this Act.

Supply of electricity to approved industry

4. Notwithstanding any other Act or law—

(a)

the Trust, in addition to its other statutory and general powers, may supply or agree to supply electricity to or for the purposes of any approved industry on such general or special terms as the Trust thinks fit;

(b)

a person (whether carrying on or intending to carry on an approved industry or not) shall not be entitled as of right under this Act or any other Act or law to a supply of electricity on the same or similar terms on which an approved industry is receiving or entitled to receive supply pursuant to this Act.
