His Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Electricity Supply Act 1995.

Explanatory note
The object of this Regulation is to clarify that a small customer may apply to the energy ombudsman for review of a decision in a dispute or complaint with an exempt seller (being persons who are not required to hold retailer authorisations).
This Regulation is made under the Electricity Supply Act 1995, including sections 96A (1), 96B (1A) (f) and
191 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Electricity Supply (General) Amendment Regulation 2018.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.
3 Amendment of Electricity Supply (General) Regulation 2014
Clause 11 Persons who may apply to energy ombudsman
Insert after clause 11 (3):
(4) In subclause (1) (a), a reference to a small customer is a reference to a person who would be a small customer of an exempt person if the exempt person were a retailer. (5) A dispute or complaint in respect of a matter referred to in subclause (1) (a) is prescribed for the purposes of section 96B (1A) (f) of the Act.
