Electricity Supply (General)

Amendment Regulation 2009

under the

Electricity Supply Act 1995

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Electricity Supply Act 1995.

Explanatory note
The object of this Regulation is to amend the Electricity Supply (General) Regulation 2001
so as:

(a) to provide that all customers who are transferred to a retailer of last resort under last resort supply arrangements may be required to pay a last resort supply fee (not exceeding $50) to that retailer (currently customers under standard form customer supply contracts are exempted from the fee), and
(b) to extend the scheme for the determination of electricity tariffs by the Independent Pricing and Regulatory Tribunal to 30 June 2013, and
(c) to extend the operation of the Electricity Tariff Equalisation Fund to 30 June 2011.

This Regulation is made under the Electricity Supply Act 1995, including sections 43EJ, 43ES and 191 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Electricity Supply (General) Amendment
Regulation 2009.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

[1]      Clause 62 Terms and conditions applying to small retail customers

Omit “(other than a transferred customer who was, immediately before the transfer, a customer under a standard form customer supply contract)” from clause 62 (5).

[2]      Clause 121A Date on which Divisions 5 and 6 of Part 4 of Act cease to have effect

Omit “30 June 2010” from clause 121A (1). Insert instead “30 June 2013”.

Omit “30 June 2010”. Insert instead “30 June 2011”.
