His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Electricity Supply Act 1995.

Explanatory note
The objects of this Regulation are:

(a) to grant an exemption from section 12 (a) of the Electricity Supply Act
1995 (which restricts the classes of person with whom, and the way in which, wholesale traders may enter into wholesale supply arrangements) to those wholesale traders who enter into electricity supply arrangements for which an exemption from section 98 of that Act is in force, and
(b) to grant an exemption from section 98 of the Electricity Supply Act 1995 (which renders certain electricity supply arrangements unenforceable) in relation to electricity supply arrangements between TransGrid (in its capacity as the New South Wales Market and System Operator) and the Victorian Power Exchange.

This Regulation is made under the Electricity Supply Act 1995, including section 106 (the general regulation making power) and, in particular, section 106 (2).

1 Name of Regulation

This Regulation is the Electricity Supply (General) Amendment

(Victorian Power Exchange) Regulation 1997.

2 Amendment

The Electricity Supply (General) Regulation 1996 is amended as set out in Schedule l .

(Clause 2)

[1] Clause 8A
Insert after clause 8:

8A Exemptions from sec. 12 (a)

( l ) The object of this clause is to exempt wholesale traders from a provision of the Act that restricts the classes of person with whom, and the way in which, they may enter into wholesale supply arrangements.

(2)       A wholesale trader is exempt from the operation of section 12 (a) of the Act in relation to any electricity supply arrangement for which an exemption under clause 1 1 is in force.

[2]        Clause 11 Exemptions from sec. 98

Insert after clause 11 (2) (a):

(a1) any arrangement under which:

(i)       electricity is supplied by the Victorian Power Exchange to the Market and System Operator, or

(ii)      electricity is supplied to the Victorian Power Exchange by the Market and System Operator,

so long as the arrangement complies with Chapter 10 (Co-extensive Rules) of the document entitled NSW State Electricity Market Code, being the rules, procedures and conditions of wholesale market operation published by TransGrid in its capacity as the Market and System Operator,
