His Excellency the Governor, with the advice of the Executive Council. has made the following Regulation under the Electriciy Supply Act 1995.

xplanatory note

The National Electricity (New South Wales) Act 1997 makes provision for the operation of a national electricity market and makes consequential amendments to the Electricity Supply Act 1995 so as to omit provisions regulating network operations and wholesale trading in the wholesale market.

The object of this Regulation is to omit those provisions of the Electricity

Supply (General) Regulation 1996 that relate to network, operations and

wholesale trading in the wholesale market. The Regulation also omits a clause under which the State Rail Authority is taken to hold certain

authorisations and licences.
This Regulation is made under the Electricity Supply Act 1995, including
section 106 (the general regulation-making power).

1 Name of Regulation

This Regulation is the Electricity Supply (General) Amendment

(National Electricity Market) Regulation 1998.

2 Commencement

This Regulation commences on 13 December 1998.

set out in Schedule 1 .

Omit "sections 6 and 13” from clause i 2 ( 1 ) .
Insert instead "section 13".

Clause 13 Energy distributors taken to hold licences

Omit clause 13 ( 1 ) (a) and (b).

Clause 13 (2) and (3)

Omit the subclauses. Insert instead:

( 2 ) Schedule 2 to the Act applies to licences that are taken to be held as referred to in subclause ( 1 ) in the same way as i t applies to licences granted in accordance with that Schedule.

Clause 14 State Rail Authority taken to hold licences

Omit the clause.
