His Excellency the Governor, on the recommendation of the Treasurer and with the advice of the Executive Council, has made the following Order under the Electricity Supply Act 1995.

Explanatory note
The object of this Order is to amend the Electricity Supply (Exemption) Order 1998 so as to exempt persons who are supplied with electricity under certain contracts from the application of Division 4 of Part 4 and Division 2 of Part 4A of the Electricity Supply Act 1995.
This Order is made under the Electricity Supply Act 1995, including sections 43E

(6) and 43P (4).

The Electricity Supply (Exemption) Order 1998 is amended as set out in Schedule 1.

[1]     Clause 2 Definition

Insert after clause 2 (d):

(e)	protected contract no 5, being the contract comprising agreements between Delta Electricity and Capral Aluminium Limited—ACN 004 213 692 for the supply of electricity during the period from and including 1 July 1999 to and including 30 September 1999,
(f)	protected contract no 6, being the contract known as the Capral (Kurri Kurri) Aluminium Smelter Contract, comprising agreements between Energy Australia and Capral Aluminium Limited—ACN 004 213 692 for the supply of electricity during the period from and including 1 October 1999 to and including 30 June 2000.

[2]    Clause 3 Electricity network services provided under protected contracts

Omit “or protected contract no 4” from clause 3 (2).
Insert instead “, protected contract no 4 or protected contracted no 6”.

[3]     Clause 3 (4)

Insert after clause 3 (3):

(4) For the purposes of this clause, electricity network services are provided to a non-franchise customer in connection with the supply of electricity to the extent that the electricity so supplied is used by the non-franchise customer and is not resupplied, or otherwise allowed to be used, by any other non-franchise customer.
