Electricity Safety (General) Amendment (Certificate of Electrical Safety) Regulations 2023

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Electricity Safety (General) Regulations 2019 to increase the authorised amount for certificates of electrical safety for the purposes of section 45B(12) of the Electricity Safety Act 1998.

2Authorising provisions

These Regulations are made under sections 152 and 157 of the Electricity Safety Act 1998.

3Commencement

These Regulations come into operation on 1 November 2023.

4Regulation 265 substituted

For regulation 265 of the Electricity Safety (General) Regulations 2019[1] substitute

"265   Authorised amount—certificates of electrical safety

(1)For the purposes of section 45B(12)(a) of the Act, the authorised amount for a certificate of electrical safety form relating to prescribed electrical installation work is—

(a)for an electronic certificate sold on or after 1 November 2023 and before 1 November 2028, 2·3 fee units; or

(b)for an electronic certificate sold on or after 1 November 2028, 2·2 fee units; or

(c)for a paper certificate sold on or after 1 November 2023 and before 1 November 2028, 2·5 fee units; or

(d)for a paper certificate sold on or after 1 November 2028, 2·4 fee units.

(2)For the purposes of section 45B(12)(b) of the Act, the authorised amount for a periodic certificate of electrical safety form is—

(a)for a periodic certificate sold on or after 1 November 2023 and before 1 November 2028, 57 fee units; or

(b)for a periodic certificate sold on or after 1 November 2028, 55·6 fee units.

(3)For the purposes of section 45B(12)(c) of the Act, the authorised amount for any other certificate of electrical safety form is—

(a)for an electronic certificate sold on or after 1 November 2023 and before 1 November 2028, $9; or

(b)for an electronic certificate sold on or after 1 November 2028, $8.10; or

(c)for a paper certificate sold on or after 1 November 2023 and before 1 November 2028, $10; or

(d)for a paper certificate sold on or after 1 November 2028, $8.90.".

Fee Units

These Regulations provide for fees by reference to fee units within the meaning of the Monetary Units Act 2004.

The amount of the fee is to be calculated, in accordance with section 7 of that Act, by multiplying the number of fee units applicable by the value of a fee unit.

The value of a fee unit for the financial year commencing 1 July 2023 is $15.90. The amount of the calculated fee may be rounded to the nearest 10 cents.

The value of a fee unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a fee unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
