(Amendment) Regulations 2001
The Governor in Council makes the following Regulations:

1. Objectives
The objectives of these Regulations are to—
(a)
prescribe standards of energy efficiency and performance for further proclaimed electrical equipment;
(b)
provide for the registration of further proclaimed electrical equipment;
(c)
provide for voluntary registration for energy labelling of three-phase airconditioners and heat pumps;
(d)
regulate the marking or labelling of three- phase cage induction motors with respect to high efficiency;
(e) revoke certain redundant regulations;

(f) make miscellaneous and consequential
amendments.
2. Authorising provisions
These Regulations are made under sections 154 and 157 of the Electricity Safety Act 1998.
3. Commencement
These Regulations come into operation on
1 October 2001.
4. Principal Regulations
In these Regulations the Electricity Safety
(Equipment Efficiency) Regulations 19991 arecalled the Principal Regulations.
5. Interpretation
(1) In regulation 5 of the Principal Regulations—
(a) in the definition of "AS 1056.1:1991", for "AS 1056.1:1991" (where twice occurring) substitute "AS 1056.1—1991"; (b) insert the following definitions—
' "AS/NZS 1359.5:2000" meansAS/NZS 1359.5:2000 as referred to in Schedule 4 and amended from time to time;
"AS/NZS 1359.102.3:2000" means
AS/NZS 1359.102.3:2000 as referred to
in Schedule 4 and amended from timeto time;
"AS 1359.102.1—1997" means
AS 1359.102.1—1997 as referred to in Schedule 4 and amended from time to time;

"AS/NZS 3823.1.1:1998" means
AS/NZS 3823.1.1:1998 as referred to in time;
"AS/NZS 3823.1.2:2001" means
AS/NZS 3823.1.2:2001 as referred to in time;
"AS/NZS 3823.2:2001" means
AS/NZS 3823.2:2001 as referred to in Schedule 4 and amended from time to time;
"AS/NZS 3823.3:2001" means
AS/NZS 3823.3.2001 as referred to in Schedule 4 and amended from time to time.'.
(c)
the definition of "relevant standard" is revoked.
(2) At the end of regulation 5 insert—
"(2) In these Regulations, a reference to a
relevant standard or a Part of a relevant
standard in relation to proclaimed electrical
equipment is to be taken to be a reference to
the applicable standard as amended from
time to time for that equipment set out inSchedule 3.".
6. Minimum standards for energy efficiency
(1) In regulation 6(1) of the Principal Regulations
omit "Part 2 of" and "Part 1 of".
(2) In regulation 6 of the Principal Regulations, for
sub-regulation (3) substitute—
"(3) Storage water heaters must comply with the
energy efficiency requirements set out in
clause 2.4 of AS 1056.1—1991 when tested

standard by a laboratory accredited by the
National Association of Testing Authoritiesor approved by the Office.
(4) Three-phase cage induction motors must
comply with the minimum efficiency
requirements set out in—
(a) when tested in accordance with
AS/NZS 1359.102.3:2000 by a
laboratory accredited by the Nationalclause 2.1 of AS/NZS 1359.5:2000 approved by the Office; or
(b) when tested in accordance with
AS 1359.102.1—1997 by a laboratory
accredited by the National Associationclause 2.2 of AS/NZS 1359.5:2000 the Office.
(5) Three-phase airconditioners and heat pumps must comply with—
(a) the performance criterion set out in clause 3.2 of AS/NZS 3823.2:2001 when tested in accordance with AS/NZS 3823.1.2:2001 (as the case
requires) by a laboratory accredited by
the National Association of TestingAS/NZS 3823.1.1:1998 or and
(b) the minimum energy performance
standard set out in clause 3.3 of
AS/NZS 3823.2:2001 when tested in
accordance with
AS/NZS 3823.1.1:1998 or
AS/NZS 3823.1.2:2001 or

| AS/NZS 3823.3:2001 (as the case requires) by a laboratory accredited by the National Association of Testing Authorities or approved by the Office.". |
7. Applications for registration
(1) In regulation 8(3) of the Principal Regulations, for "An application for the registration of proclaimed electrical equipment that is listed in Schedule 4
must—" substitute "An application for the
registration of a storage water heater must—".
(2) After regulation 8(3) of the Principal Regulations
insert—
"(3A) An application for the registration of a three- phase cage induction motor must—
(a) be made in accordance with the requirements for an application for registration set out in section 4 of AS/NZS 1359.5:2000; and (b) be in the form set out in Appendix A of AS/NZS 1359.5:2000; and (c) specify whether the equipment
complies with the minimum efficiency
requirements prescribed in regulation
6(4); and(d) be accompanied by the relevant fee set out in Schedule 2.
(3B) An application for the registration of a three- phase airconditioner or heat pump must—
(a)
be made in accordance with the requirements for an application for registration set out in section 4 of AS/NZS 3823.2:2001; and
(b)
be in the form set out in Appendix C of AS/NZS 3823.2:2001; and

(c) specify whether the equipment
complies with the performance criterion
and the minimum energy performance
standard prescribed in regulation 6(5);
and(d) be accompanied by the relevant fee set out in Schedule 2; and (e) energy labelling, include or be
accompanied by an application in the
form of Appendix B ofif the applicant elects to register for accompanied by—
(i) calculations referred to in
the results of testing and and
(ii) equipment label to be attached to
a sample of the electrical heat pump.
(3C) An application for the registration of a three- phase airconditioner or heat pump for energy labelling, if the airconditioner or heat pump
is already registered for the minimum energy
performance standard, must—
(a)
be made in accordance with the requirements for an application for registration set out in section 4 of AS/NZS 3823.2:2001; and
(b)
be in the form set out in Appendix B of AS/NZS 3823.2:2001; and
(c) be accompanied by—

the results of testing and and
(ii) equipment label to be attached to
a sample of the electrical heat pump.".
8. Requirements for registration or transfer
(1) In regulation 11 of the Principal Regulations, for
paragraph (a) substitute—
"(a) in the case of equipment listed in
Schedule 3—
(i) the equipment complies with the requirements of regulation 6(1); and
(ii) the electrical equipment label complies 16(1)(a);".
(2) In regulation 11 of the Principal Regulations, for
paragraph (c) substitute—
"(c) in the case of equipment referred to in
Schedule 4—
(i) that are storage water heaters, the requirements of regulation 6(3);
(ii) that are three-phase cage induction the requirements of regulation 6(4);
(iii) heat pumps, the equipment complies
that are three-phase airconditioners or regulation 6(5).

(d) in the case of three-phase airconditioners or heat pumps where the applicant elects to be registered for energy labelling, in addition to the requirements of paragraph (c)(iii), the electrical equipment label complies with regulation 16(2)(a).".
9. Cancellation of registration
In regulation 13(1)(a) of the Principal
Regulations—
(a) at the end of sub-paragraph (i) insert "or";
(b)
for sub-paragraph (ii) substitute— "(ii) a sample of the equipment does not
comply with—
(A) in the case of water storage
heaters, the energy efficiency
requirements of regulation 6(3); or
(B) in the case of three-phase cage induction motors, the minimum efficiency requirements of
regulation 6(4); or
(C) in the case of three-phase
airconditioners and heat pumps,
the performance criterion and the
minimum energy performance
standard prescribed in regulation6(5); or
(D) in the case of three-phase cage
induction motors that are marked
or labelled as high efficiency
motors, the relevant minimum
high efficiency level prescribed in
regulation 16(3);".

10. Revocation of regulation dealing with offers to supply proclaimed electrical equipment
Regulation 15 of the Principal Regulations is revoked.
11. Voluntary labelling of three-phase airconditioners and heat pumps
At the end of regulation 16 of the Principal
Regulations insert—"(2) A person must not supply or offer to supply
a three-phase airconditioner or heat pump
which has been registered for energylabelling unless the label—
(a) states the comparative energy index of the airconditioner or heat pump as determined in accordance with section 2 of AS/NZS 3823.2:2001; and
(b) is in the form and contains the particulars set out in section 5 of AS/NZS 3823.2:2001; and (c) is attached to the airconditioner or heat pump as— (i) described in section 5 of AS/NZS 3823.2:2001; or
(ii) approved in writing by a person or body referred to in regulation 7; and
(d)
is not attached in such a manner that the label is obscured; and
(e)
does not contain any words, figures or symbols that mislead or are likely to mislead with respect to the comparative energy consumption, star rating, star rating index or performance

heat pump.(3) A person must not supply or offer to supply
a three-phase cage induction motor that is
marked or labelled as a high efficiency
motor unless—
(a) that the motor complies with the
minimum high efficiency level set outthe mark or label specifies or indicates AS/NZS 1359.5:2000; and
(b)
the motor complies with the minimum high efficiency level specified or indicated by the mark or label and set out in—
(i) clause 3.1 of
AS/NZS 1359.5:2000 when tested
in accordance with
AS/NZS 1359.102.3:2000 by a
laboratory accredited by the
National Association of Testing
Authorities or approved by the
Office; or(ii) clause 3.2 of
AS/NZS 1359.5:2000 when tested
in accordance with
AS 1359.102.1—1997 by a
laboratory accredited by the
National Association of Testing
Authorities or approved by the
Office.".
12. Revocation of regulation dealing with offers to supply proclaimed electrical equipment

In regulation 17 of the Principal Regulations, sub-regulations (1) and (3) are revoked.
13. Amendment of Schedule 3 to amend name of equipment and titles of standards
In Schedule 3 to the Principal Regulations—
(a) for the words and expressions set out
opposite "Room airconditioners" in thein the column headed "Relevant standard", equipment" substitute—
"Australian/New Zealand Standard, 'Performance of
