Electricity Safety (Equipment Efficiency)
(Amendment) Regulations 2000
The Governor in Council makes the following Regulations:

1. Objectives
The objectives of these Regulations are—
(a) to prescribe new standards of energy electrical equipment; and
(b)
to provide that compliance with standards required by the Principal Regulations as in force immediately before the commencement
of these Regulations is sufficient until
30 September 2000.
2. Authorising provisions
These Regulations are made under sections 154 and 157 of the Electricity Safety Act 1998.

3. Commencement
These Regulations come into operation on 17 May
2000.
4. Principal Regulations
In these Regulations, the Electricity Safety
(Equipment Efficiency) Regulations 19991 arecalled the Principal Regulations.
5. New definition substituted
In regulation 5 of the Principal Regulations, for
the definition of "AS/NZS 4474.2:1997"
substitute—' "AS/NZS 4474.2:2000" means AS/NZS
4474.2:2000 as referred to in Schedule 3 and
amended from time to time;'.
6. Minimum energy performance standards
In regulation 6(2) of the Principal Regulations, for
"AS/NZS 4474.2:1997" substitute "AS/NZS4474.2:2000".
7. Applications for registration
(1) In regulation 8 of the Principal Regulations—
(a) in sub-regulation (2)(b), omit "for energy efficiency"; (b) in sub-regulation (6), for "sub-regulation (2)(c)(i) and (iii)".
(2) After regulation 8(6) of the Principal Regulations,
insert—
"(7) The Office may rebate the payment of aregistration fee or part of a registration fee paid under sub-regulation (2)(c)(iv) if the Office has granted the registration for a
period of less than 12 months.".

8. Electrical equipment labels
In regulation 16 of the Principal Regulations—
(a)
for paragraph (a) substitute— "(a) state the comparative energy
consumption, star rating and star rating
index of the equipment as determined
in accordance with section 2 of Part 2of the relevant standard; and";
(b) in paragraph (e)—
(i) after "star rating," insert "star rating index";
(ii) omit "energy efficiency rating (or, in energy efficiency value)".
9. Offer of supply
In regulation 17(2)(b)(ii) of the Principal
Regulations—
(a) after "star rating," insert "star rating index";
(b)
omit "energy efficiency rating (or, in the case of room airconditioners, energy efficiency value)".
10. New regulation 24 inserted
After regulation 23 of the Principal Regulations,
insert—"24. Further transitionals
(1) Despite regulation 6(1), proclaimed
electrical equipment (other than refrigerating appliances) listed in Schedule 3 may comply with the performance criteria set out in Part 2 of the relevant standard in Schedule 3 as in
force immediately before 17 May 2000 when

tested in accordance with regulation 6(1) or with an equivalent standard approved by the Office under sub-regulation (3).
(2) Despite regulation 6(1) and (2), refrigerating
appliances may comply the performance
criteria set out in AS/NZS 4474.2:1997 when
tested in accordance with AS/NZS
4474.1:1997 or with an equivalent standard
approved by the Office under sub-regulation
(3).
(3) A model of a brand of proclaimed electrical
equipment listed in Schedule 3, having the
same relevant physical characteristics,
energy efficiency and performance
characteristics as a model of a brand that is
registered or deemed to be registered under
these Regulations, may be tested in
accordance with a standard that the Office is
satisfied is at least equivalent to Part 1 of the
relevant standard for the purpose of
determining compliance with the
performance criteria set out in Part 2 of the
relevant standard whether before, on or after17 May 2000.
(4) Despite regulation 8(2), an application for
registration of proclaimed electrical
equipment provided for in sub-regulation (1)or (2) must—
(a) be in the form set out in Part 2 of the relevant standard in Schedule 3 as in force immediately before 17 May 2000; and
(b) specify whether—
(i) in the case of electrical equipment (other than refrigerating

complies with sub-regulation (1);
(ii) in the case of the refrigerating with sub-regulation (2); and
(c) be accompanied by results of testing and calculations referred to in section 2 of Part 2 of the relevant standard in Schedule 3 as in force immediately before 17 May 2000. (5) Despite regulation 8(2)(c)(iii), an application
for registration of proclaimed electrical
equipment provided for in sub-regulation (3)
must be accompanied by the results of
testing referred to in sub-regulation (3) in the
form described in the equivalent standard
approved by the Office under sub-regulation
(3).
(6) Despite regulation 16, an electrical
equipment label for proclaimed electrical equipment that is registered in accordance with this regulation must comply with
regulation 16 as in force immediately before
17 May 2000.(7) Despite regulation 11, the Office may register or transfer the registration of proclaimed electrical equipment if in the
opinion of the Office—
(a)
in the case of proclaimed electrical equipment listed in Schedule 3 (other than a refrigerating appliance)—
(i) the equipment complies with sub-
regulation (1); and(ii) the electrical equipment label
complies with regulation 16(a) as

in force immediately before
17 May 2000;
(b)
in the case of a refrigerating appliance—
(i) the appliance complies with sub-
regulation (2); and(ii) the electrical equipment label
complies with regulation 16(a) as
in force immediately before
17 May 2000.
(8) This regulation ceases to have any force or
effect on 30 September 2000.".
11. New relevant standards substituted
In Schedule 3 to the Principal Regulations—
(a) for "AS/NZS 2040.2:1998" substitute
"AS/NZS 2040.2:2000";(b) for "AS/NZS 2007.2:1998" substitute
"AS/NZS 2007.2:2000";(c) for "AS/NZS 4474.2:1997" substitute
"AS/NZS 4474.2:2000";(d) for "AS/NZS 3823.2:1998" substitute
"AS/NZS 3823.2:2000";(e) for "AS/NZS 2442.2:1996" substitute
"AS/NZS 2442.2:2000".
