Explanatory note
The object of this Regulation is to amend the Electricity Safety (Equipment Efficiency) Regulation 1999 so as to prescribe new standards of energy efficiency and performance for certain electrical articles and to prescribe new standards for the registration and labelling of such articles. The regulation also provides that the requirement that certain electrical articles must not be sold unless they are registered does not apply to the sale of second-hand articles.
This Regulation is made under the Electricity Safety Act 1945, including sections

21A and 37 (the general power to make regulations).

1     Name of Regulation

This Regulation is the Electricity Safety (Equipment Efficiency)

Amendment (Registration and Labelling) Regulation 2000.

2 Commencement

This Regulation commences on 11 August 2000.

3 Amendment of Electricity Safety (Equipment Efficiency) Regulation 1999

The Electricity Safety (Equipment Efficiency) Regulation 1999 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

(Clause 3)

[1]     Clause 5 (1A)

Insert after clause 5 (1):

(1A) Until the end of 30 September 2000, a reference to the relevant standard in subclause (1) includes a reference to the standard indicated in Schedule 2 (as in force immediately before 11 August 2000) as being applicable to the electrical article concerned.

[2]     Clause 7 (7)

Insert after clause 7 (6):

(7) An application for registration of an electrical article listed in Schedule 2 may be made, until the end of 31 August 2000, as if a reference to the relevant standard in subclause (2) is a reference to the standard indicated in Schedule 2 (as in force immediately before 11 August 2000) as being applicable to the electrical article concerned.

(8) Despite clause 11, the Corporation can only register an electrical article that is the subject of an application referred to in subclause (7) for a term that does not extend beyond 30 September 2000.

(9) Without limiting subclause (6), the Corporation may refund all or part of the fee paid in relation to an application referred to in subclause (7) if the Corporation considers that the circumstances warrant it.

[3]     Clause 14 Sale of electrical articles

Insert at the end of the clause:

(2) This clause applies in respect of the sale of new articles, whether by wholesale or retail, but does not apply to the sale of second-hand articles.

Schedule 1 Amendments

[4]     Clause 15 Electrical articles to be appropriately labelled when sold

Insert after clause 15 (3):

(4) However, a person does not commit an offence against subclause (1) by selling an electrical article on which an approved energy efficiency label is displayed in accordance with Part 2 of the previous relevant standard if the sale occurs:

(a) in the case of a clothes washing machine, dishwasher, refrigerating appliance or rotary clothes dryer that has not been used for display purposes and is existing packaged stock as at 1 October 2000—before 1 October 2001,
(b) in the case of a room airconditioner that has not been used for display purposes and is existing packaged stock as at 1 October 2000—before 1 October 2002,
(c) in any other case—before 1 October 2000.

(5) In subclause (4), previous relevant standard means the standard indicated in Schedule 2 (as in force immediately before 11 August 2000) as being applicable to the electrical article concerned.

[5]     Clause 16 Use of display fronts

Insert at the end of clause 16:

(2) Until the end of 30 September 2000, a reference to the relevant standard in subclause (1) includes a reference to the standard indicated in Schedule 2 (as in force immediately before 11 August 2000) as being applicable to the electrical article concerned.
