Regulation 2000

Electricity Safety Act 1945

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Electricity Safety Act 1945.

Explanatory note
The object of this Regulation is to amend the Electricity Safety (Corrosion

Protection) Regulation 1998:

(a)

to make it clear that periodic examinations or tests of cathodic protection equipment may be carried out by the Director-General of the Ministry of Energy and Utilities, and

(b)

to permit the Director-General to determine fees for examinations and tests of cathodic protection equipment, and

(c) to update outdated references.

This Regulation is made under the Electricity Safety Act 1945, including section

37 (1) (the general regulation-making power) and section 37 (2) (b) and (d).

1     Name of Regulation

This Regulation is the Electricity Safety (Corrosion Protection)

Amendment Regulation 2000.

2 Commencement

This Regulation commences on 22 September 2000.

3 Amendment of Electricity Safety (Corrosion Protection) Regulation 1998

The Electricity Safety (Corrosion Protection) Regulation 1998 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

(Clause 3)

[1]     Clause 3 Definitions

Omit the definitions of Department and Departmental guidelines from clause 3 (1).

[2]     Clause 3 (1), definition of “Director-General”

Omit the definition. Insert instead:

Director-General means the Director-General of the Ministry of Energy and Utilities.

[3]     Clause 3 (1)

Insert in alphabetical order:

Ministry

means the Ministry of Energy and Utilities. approved by the Director-General under clause 14.

[4]     Clause 7 Approvals for cathodic protection systems

Omit “Department” from clause 7 (1) (f). Insert instead “Ministry”.

[5]     Clause 9 Objections to continued operation of cathodic protection systems

Omit “Department” from clause 9 (2) (c). Insert instead “Ministry”.

[6]     Clause 12 Examination and testing of cathodic protection systems

Omit “examined and tested” from clause 12 (1).
Insert instead “examined or tested, or both examined and tested”.

[7]     Clause 12 (1A)

Insert after clause 12 (1):

(1A) Without limiting subclause (1), the Director-General may at such periodic intervals as the Director-General determines, examine or test or both examine and test approved systems.

Insert after clause 12:

12A Fees for examination or testing

(1) The Director-General may determine the fee payable for the examination or testing or examination and testing of a cathodic protection system under clause 12, including fees for periodic examinations or tests.

(2) The fee is payable by the holder of the approval for the

cathodic protection system that is examined or tested.

(3) The Director-General may determine different fees for different classes of systems and different fees for different examinations or tests.
(4) The Director-General may, in any case, waive the whole or part
of a fee.

Omit “Departmental guidelines” from clause 14 (2).
Insert instead “Ministry guidelines”.
