Electricity (Pricing Order) Amendment Act 2003

An Act to amend the Electricity Act 1996.

The Parliament of South Australia enacts as follows:

1—Short title

  1. (1)

    This Act may be cited as the Electricity (Pricing Order) Amendment Act 2003.

  2. (2)

    The Electricity Act 1996 is referred to in this Act as "the principal Act".

2—Amendment of s. 35A—Price regulation by Commission

Section 35A of the principal Act is amended by striking out "Treasurer" wherever occurring and substituting, in each case, "Minister".

3—Amendment of s. 35B—Initial electricity pricing order

Section 35B of the principal Act is amended—

  1. (a)

    by inserting in subsection (10a)(a) "and is further varied as proposed by the Minister by notice published in the Gazette on 5 December 2002 at page 4458" after "page 3397";

  2. (b)

    by striking out paragraph (b) of subsection (10a) and substituting the following paragraph:

    1. (b)

      the Minister must ensure that copies of the order as so varied are sent to each licensed entity to which the order applies and are made available for inspection and purchase by members of the public;.

4—Exclusion of Crown liability in relation to electricity pricing order

  1. (1)

    No liability (including contractual liability) is incurred by the Crown in connection with the further variation of the electricity pricing order notified in the Gazette on 11 October 1999 at page 1471.
